Terms of Use

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your personal, non-commercial use. This license is also subject to the Apple Licensed Application End User License Agreement.

3. No Account Required

The App does not offer or require user accounts. There is nothing to register, no credentials to manage, and no profile held by us. Your workout data is stored on your own device, and you are responsible for safeguarding the device it lives on and for any backups you choose to make (for example via your own device backup). See section 6.

4. Health and Fitness Disclaimer

The App records and displays fitness information such as pace, distance, heart rate, estimated calories, and estimated power. This information is provided for general fitness purposes only and is not medical advice. Estimates (including calorie and power figures) are approximations and may be inaccurate. Always consult a physician before beginning any exercise program, and stop exercising immediately if you feel pain, faintness, or discomfort. You use the App during physical activity at your own risk — stay aware of traffic and your surroundings.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful, harmful, or fraudulent purpose.
• Reverse engineer, decompile, or attempt to extract source code from the App.
• Interfere with or disrupt the App's operation or the third-party services it relies on.
• Remove or alter any proprietary notices in the App.

6. Your Data

All workout data you record with the App is stored locally on your device and belongs to you. We do not host, store, or process your workouts on any server, and consequently we cannot recover them for you. Deleting the App, using the in-app "Delete All Data" feature, or losing your device may permanently destroy your data. You can export workouts as GPX files from within the App; making such exports and backups is your responsibility. How data is handled is described in the Privacy Policy.

7. Intellectual Property

The App, including its design, code, graphics, logos, and trademarks, is owned by Angel Terziev and protected by applicable intellectual property laws. Except for the limited license granted above, no rights are transferred to you under these Terms.

8. Tips (In-App Purchases)

The App is free to use. It offers optional, one-time tips as in-app purchases to support development. Tips are voluntary, unlock no features, and are not subscriptions — nothing renews automatically. All payments are processed by Apple through the App Store and are subject to Apple's terms; refund requests are handled by Apple.

9. Updates and Changes

We may release updates, add new features, modify existing features, or discontinue the App (or parts of it) at any time without notice. We are not liable for any modification, suspension, or discontinuation of the App.

10. Termination

These Terms apply for as long as you use the App. We may terminate the license granted above if you violate these Terms. You may stop using the App at any time by deleting it; your locally stored data is removed along with it.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the App will be uninterrupted, error-free, or secure. GPS, sensor, and estimation accuracy depend on your device, environment, and conditions and are not guaranteed. Your use of the App is at your sole risk.

12. Limitation of Liability

To the maximum extent permitted by law, Angel Terziev shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use — including loss of workout data — arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or fifty euros (€50), whichever is greater. Nothing in these Terms limits liability that cannot be limited under applicable law, including mandatory consumer protection rights.

13. Indemnification

You agree to indemnify and hold harmless Angel Terziev from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the App or your violation of these Terms.

14. Third-Party Services

The App relies on Apple services (such as HealthKit, the App Store, and Apple Watch connectivity) and uses Google Firebase for anonymous diagnostics, as described in the Privacy Policy. We are not responsible for the content, policies, or practices of any third party. Your use of such services is subject to their own terms and policies.

15. Apple-Specific Terms

You acknowledge that these Terms are between you and Angel Terziev, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple is a third-party beneficiary of these Terms and may enforce them against you.

16. Governing Law

These Terms are governed by the laws of the Republic of Bulgaria, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the courts of Sofia, Bulgaria, unless otherwise required by applicable consumer protection law, which may entitle you to bring proceedings in your country of residence.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you within the App. Your continued use of the App after the changes take effect constitutes acceptance of the revised Terms.
